Terms of Service

To access Follix, you must register for an account by providing an accurate legal name, email address, and secure password. You represent that you are at least 18 years of age or the age of majority in your jurisdiction.

You are solely responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to notify us immediately at security@follix.io if you discover or suspect unauthorized access.

You agree to use Follix in compliance with all applicable local, national, and international laws, including privacy regulations (e.g., GDPR, CCPA, CAN-SPAM). You agree not to:

• Upload, transmit, or process unlawful, defamatory, or fraudulent content.
• Attempt to bypass authentication, probe infrastructure security, or reverse engineer any part of the service.
• Transmit automated mass marketing spam or harass prospective leads through connected communication channels.
• Interfere with or disrupt the normal operation, integrity, or performance of the platform.

You Own Your Data: You retain full title, ownership, and intellectual property rights in all data, leads, contacts, deals, notes, and communications submitted into your Follix workspace ("Customer Data").

You grant Follix a worldwide, limited, non-exclusive license solely to host, process, cache, and transmit your Customer Data for the sole purpose of operating, maintaining, and improving the follow-up service for you. Follix does not sell, rent, or monetize your Customer Data.

Follix Intellectual Property: Follix, including its software, logos, trademarks, visual design, documentation, and user interfaces, is the exclusive property of Follix Inc. and its licensors.

Paid plans are billed in advance on a recurring monthly or annual cycle, as selected during checkout. All payments are securely processed by Stripe.

Cancellations: You may cancel your subscription at any time directly through your billing settings. Your plan will remain active until the end of your current paid billing period, and you will not be billed again.

Refunds: Except as required by applicable statutory consumer protection laws, fees paid are non-refundable. If you experience an issue or believe you were billed in error, please contact billing@follix.io.

The service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Follix does not guarantee specific commercial outcomes, such as sales closing rates, revenue increases, or client responses. You retain ultimate responsibility for your sales interactions and customer relationships.

To the maximum extent permitted by applicable law, in no event shall Follix, its affiliates, directors, employees, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, revenue, or business opportunities.

The aggregate liability of Follix arising out of or relating to these Terms or the service shall not exceed the total amount paid by you to Follix in the twelve (12) months preceding the incident giving rise to the claim, or fifty U.S. dollars ($50), whichever is greater.

You agree to defend, indemnify, and hold harmless Follix, its officers, directors, employees, and agents from and against any third-party claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your violation of these Terms, your Customer Data, or your unlawful use of the service.

You may terminate your account at any time. Follix may suspend or terminate your account if you materially breach these Terms or if necessary to comply with legal obligations.

Upon termination, you will have a 30-day grace period to export your Customer Data upon request. Following this window, we will permanently delete your Customer Data from active production databases in accordance with our Privacy Policy.

We may revise these Terms from time to time to reflect product enhancements, legal requirements, or business updates. When modifications are material, we will provide notice via email or a prominent banner within the platform.

Continued use of Follix after the effective date of updated Terms constitutes your acceptance of the revised agreement.

These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of Delaware, United States, without regard to its conflict of laws principles.

Before initiating formal legal proceedings, both parties agree to attempt in good faith to resolve any dispute through informal negotiation by contacting legal@follix.io.
